1. PACKAGES AND RATES
The base session package is $1,349 + taxes and includes up to 2 animals.
Additional fees:
Additional animals: $75 + taxes per animal from the 3rd animal onwards
Travel fees: $0.72 per kilometer for travel beyond a 50 km radius (round-trip distance). The photographer is based in Aylmer (postal code J9H 7T6).
Prices may be changed without notice.
2. PAYMENT
Payment for products and services must be made by debit/credit or bank transfer.
Session package payment options:
a) Full payment:
The total package amount ($1,349 + taxes, plus any additional fees) paid at the time of booking.
b) Partial deposit:
A deposit of $400 + taxes (plus fees for additional animals and travel fees if applicable) paid at the time of booking. The balance of $949 + taxes must be paid at least 7 days before the session date.
Any amount paid to the photographer is immediately and definitively earned and is NON-REFUNDABLE, subject to the right of withdrawal provided in section 3.
No session will be conducted without full payment in advance.
Payment for photos and printed products:
Digital photos and printed products ordered during photo selection must be paid for at the time of order. Digital files will only be delivered once full payment is received.
Personalized payment arrangements may be discussed and approved in writing on a case-by-case basis.
3. RIGHT OF WITHDRAWAL (QUEBEC CONSUMER PROTECTION ACT)
If the contract was concluded remotely (online, by phone, or by mail), the client has a period of 10 days following the signing of the contract to cancel it without fees or penalty and obtain a full refund of all amounts paid, in accordance with Quebec's Consumer Protection Act.
To exercise this right, the client must send written notice (email accepted) to the photographer within the 10-day period.
4. CANCELLATION AND RESCHEDULING
Cancellation by the client (after the 10-day withdrawal period):
Less than 48 hours before the session or absence without notice: All amounts paid will be forfeited.
More than 48 hours before the session: The client may request to reschedule the session.
Rescheduling:
A session may be rescheduled if notice is given at least 48 hours before the scheduled event. The new session must be rescheduled within the same calendar year. If the client cannot attend the rescheduled session or requests a second rescheduling, all amounts paid will be forfeited.
Cancellation by the photographer:
The session may be cancelled by the photographer in case of bad weather, illness, emergency or unforeseen circumstances. In this case, the photographer will inform the client and the session will be rescheduled to another date that suits the client. If a new date cannot be agreed upon, the photographer will refund the amounts paid.
5. DELIVERY TIMES
Online gallery:
The photographer will send the client an online gallery containing the session photos within 1 to 3 weeks following the session. The timeline may vary depending on the photographer's workload and season.
Final digital photos:
Once the client has made their photo selection and made full payment, the photographer will deliver the final high-resolution digital files within 2 to 4 weeks.
Printed products:
Delivery of printed products is done within 2 to 8 weeks following the order.
6. FILE TYPES AND USAGE LICENSES
High-resolution files (digital use only):
The high-resolution files included in the package are intended for digital use only (social media, screen display, digital frames). These files have a very slight artist's mark that is practically imperceptible during normal viewing. These files are not optimized for printing and do not include a printing license.
Full-resolution files with print license:
Full-resolution files with print license are available for purchase after the session if the client wishes to print the photos themselves. These files are specially prepared for high-quality printing and do not contain any watermark or logo. These files are offered at a different rate than files intended for digital use only.
The client may choose to purchase a mix of both file types. Any price difference will be applied to the final balance.
7. PRINTED PRODUCTS
No printed products are included in the base session price.
Printed products are available for purchase separately according to the current price list.
Exchanges and refunds:
Printed products may be exchanged if there is proof of damage. No refunds are offered for printed products.
8. ONLINE GALLERY
Access duration:
The online gallery expires 14 days following the date sent to the client. The client will receive an email reminder 48 hours before expiration. The expiration date may be extended once for an additional 7 days with the photographer's approval.
Reactivation:
After expiration, a fee of $50 applies for gallery reactivation to cover storage and hosting costs.
Screenshots prohibited:
Screenshots or any other means of copying photos from the online gallery are strictly prohibited and are considered theft. The client will be billed and agrees to pay the total fees for photos copied or screenshotted.
9. RETOUCHING AND ARTISTIC STYLE
The photographer performs standard professional retouching on all delivered photos according to their established artistic style, including color, exposure, contrast adjustments and removal of minor small distractions.
The client may request minor modifications to retouching (e.g., brightness, contrast adjustments) within 7 days of receiving the final photos. However, the retouching style is an integral part of the photographer's artistic style and cannot be modified.
Major or special retouching is not included in the base package and may be billed separately according to the time and expertise required.
10. COPYRIGHT AND USE
Intellectual property:
The photographer retains ownership of the images and copyright on all images created. Any duplication or alteration of the original images is strictly prohibited without the photographer's written permission.
Client use:
Digital files or prints are intended for personal use only. The client must not substantially modify the image in a manner that would alter the artistic integrity of the photograph. Minor cropping to adapt to different formats (frames, social media) is permitted as long as it does not distort the main subject.
Social media sharing:
The client may share photos provided by the photographer on their personal and professional social media accounts, once they have paid in full for these photos.
Photographer's publication rights:
The client grants the photographer the unconditional right to use, transmit, display and publish photographs for portfolio, marketing, advertising, contest entries, social media publications or any other lawful professional purposes without compensation or other consideration.
The client may request the removal of certain specific images from public distribution for legitimate personal reasons.
11. RESPONSIBILITIES
Liability waiver:
Although the photographer strives to ensure a safe and professional photography session, certain circumstances are beyond their control. The client agrees that the photographer is released from all liability in the event of injury to the client, persons accompanying them, and their pet during the session.
File backup:
Backup and storage of purchased digital photos are entirely the client's responsibility.
Limitation of liability:
In the event of loss or damage to photographic files due to technological malfunctions without fault on the part of the photographer, the photographer's liability will be limited to a full refund of the amounts paid.
12. DISCOUNTS AND PROMOTIONS
Discounts cannot be combined with other discounts, unless otherwise indicated.
13. PROTECTION OF PERSONAL INFORMATION
The photographer commits to protecting the client's personal information in accordance with applicable privacy laws. Information collected will be used solely for the purpose of providing photographic services and will not be shared with third parties without the client's consent, except if required by law.
The client may request access, correction or deletion of their personal information by contacting the photographer in writing.
14. RIGHT TO REFUSE SERVICE
Carlos A. Miljour Animal Photographer reserves the right to refuse service at any time.
15. SESSION CONFIRMATION
Sessions are considered final and confirmed only once the session fees are paid in full and the contract is signed and submitted.
